This is to inform all the participants of Conficiendis Legislativa that the results for the said competition were announced at the end of the Symposium on Regulation of Hookah Parlours conducted at Pravin Gandhi College of Law.  The final individual scores will be put up shortly on the Moot Court Society Blog. WOMEN SHAKTI SANGH

v.

TEMPLE OF RAGABIBI

Temple of Ragabibi was established in the 8^th century in the state of Mahatrib by the Hindu community of Deshnaf, who are now notified as a Schedule Caste. There is a popular folklore surrounding the deity of the God Narsimha. This folklore states that Narsimha, the king of Mahatrib, was blessed by Lord Shiva, that he would have the power to grant wishes, but if he ever looked at a woman, he would lose all his magical, wish granting powers.

Accordingly tradition has developed to not allow women above the age of 9 into the temple. This practice, of not allowing women in the temple has been carried on uninterruptedly since the 8^th century. However, pictures and replicas of the deity are sold on the pavements outside the temple to everyone.

Women Shakti Sangh (WSS)  is an NGO made up of women and trangenders rights activists, who want equality of status to all genders. Their head office is at Tilkan, neighbouring state of Mahatrib. They noticed this customary practice when it was reported in an article in a leading English newspaper. They sent a team of researchers to find out the authenticity of this report and discovered that the article was indeed true. Outraged by this discriminatory practice, they got in touch with the local women and organised a peaceful rally against this unfair tradition and demanded that the temple authorities open the gate to everyone. They agitated for a week but the temple authorities refused to open the gates of the temple to women and transgender.

Ultimately, the NGO, WSS filed a PIL under Article 32 of the constitution, stating that this was discriminatory and violated articles 14 and 15 of the Constitution of India. The temple authorities have defended their position stating they have a Fundamental Right to Religion.

MEMORIALS

 The written memorials shall conform to the set standards:

1. Written submissions shall be printed on white standard A4 size paper.

2. The font and size of the text used in all parts of the written submissions (except the covers) shall be in Times New Roman size 12 and footnotes shall be in Times New Roman size 10.

3. The text in all parts of each written submission shall have 2 line spacing except the text of footnotes and headings which shall be single spaced.

4. The comprehensive arguments with appropriate citations shall be contained in the Pleadings. The teams shall follow the 19th edition of the Bluebook mode of citation. The Pleadings shall not exceed 25 pages.

5. The cover page of the Memorials should be BLUE for appellant and RED for the respondent, soft cover and stapled.

6. Five copies of each side should be submitted (i.e. 5 Petitioner + 5 Respondent=10 copies).

7. Soft copy submission of memorials- 11^th March, 2016 latest by 11:59 p.m. on pgclintra@gmail.com 

8. Hard copy Submission of memorials- 12^th March, 2016 from 12 p.m. onwards till 3 p.m.

9.  Late submission of memorials will lead to negative marking of 1 point by every 1 hour from 3:00 p.m. to 5:00 p.m. on 12th March, 2016. A penalty of 4 marks will be imposed on the teams submitting the memorials after 6:00 p.m. No Memorials shall be accepted after 12:10 pm on 13th March, 2016.

STRUCTURE OF ROUNDS

The oral rounds shall comprise of:

a) Preliminary Rounds

b) Quarter-final Rounds

c) Semi-final Rounds and

d) Final Round

Each side shall be allowed 25 minutes for their oral submissions (Including rebuttal). One speaker cannot exceed 10 minutes in the Preliminary Round and Quarter-final Rounds. In the Semi-finals and the Finals the teams have 45 minutes for their oral presentations (Including rebuttal), one speaker cannot exceed 20 minutes.

The marks for memorials shall not be included in the marks for oral submissions for the purpose of calculating the total in the Preliminary Round; however in case of a tie the same shall be included.

RESEARCHER’S TEST

      A Researcher’s Test shall also be conducted for adjudicating the ‘Best Researcher’ on 16^th of March, 2016. The Researcher’s Test is not compulsory and those who are not participating in the Moot Court Competition may also participate in the Researcher’s Test.

Moot Proposition

                       The Republic of Westeros is a country situated in West Asia and was a colony of the British Empire for over 200 years. Westeros achieved Independence in the year 1951 and the cultural, social and political situation of the country is similar to that of India. It is a diverse country with multiple religions, languages and people of different classes. The laws of Westeros are pari materia with the laws of India. The judgments pronounced by the various High Courts and the Supreme Court of India carry a very high persuasive value with the courts of Westeros.

        On 2^nd May 2015, Mr. Tyrion Lannister who is the President of the Lannister Party published a list of “Westeros’s Most Corrupt People” which included the name of Mr. Jon Snow who is a leader of another prominent political party. Thereafter, Mr. Snow proceeded with filing a criminal complaint for defamation under section 500 of the Westeros Penal Code (WPC). These proceedings were later stayed by the Supreme Court of Westeros. In the run-up to the 2015 Lok Sabha polls of Westeros, politicians from various parties filed several defamations cases against each other for comments that could have been simply dismissed as political banter. Moreover, the Baratheon government in the state of Bravos has filed dozens of criminal defamation cases against media houses in various session courts across the state, for pointing out lapses on the part of the administration.

 

         Due to these events, several Writ Petitions were filed before the Supreme Court challenging the constitutionality of sections 499 and 500 of the WPC which deal with the offence of Defamation with the lead petitioner being Society for Freedom of Speech (SFFS). A notice was sent out to Union of Westeros seeking its opinion/viewpoint as to why defamation should not be decriminalized and should just be a civil wrong.

          The Petitioners argued that these provisions are being misused to curb the freedom of media as well the right to free speech. They relied on the examples of England where defamation is no more an offence and the landmark case of Shreya Singhal v Union of India amongst others. The Respondent argued that defamation comes within the ambit of reasonable restrictions under Article 19 of the Constitution of Westeros.

         The Hon’ble Supreme Court has framed the following issues:

1.      Whether the Writ Petition is Maintainable?

2.      Whether section 499 and section 500 of the WPC violate Part III of the Constitution?

3.      Whether these sections are unconstitutional and must be struck down by the Court?
